Abstract

A fatwa is often influenced by social and political conditions that occur when the fatwa was born. It is possible also occurred in 1954 when Lajnah Bahtsul Masail Nahdhatul Ulama (NU-LBM) decided that the President of the Republic of Indonesia, Ir. Sukarno was waliyul amri dharury bisy syaukah. Although LBMNU fatwa based on fiqh, especially the fiqh Syafi’iyah. Someone says that the fatwa is influenced by maintaining position in Departemen Agama Religion Department) as managing board. Regardless that opinion, actually, NU maintains his power on Departemen Agama until 1971. This paper will simply want to research this fatwa and connecting it with the social realities when the fatwa is issued.

Abstract

Decision about first day of qamariyah months, especially in regard to worship (Ramadan, Shawwal, Zulhijjah) is determined by the appearance of the new moon. When the sun sets and the moon is above the horizon, which is an indication that the new moon has been there. But in reality, Ulama differ in determining whether the initial first day of qomariah months shall be based rukyat (observe of moon appearance) or can be based hisab (calculation). This is not apart from understanding dalil (reason based on Prophet exemplary).

Abstract

Sjech. M. Djamil known as a reformer scholars in various fields including in education, theology and tarekat (Islamic religious order) in Minangkabau. This paper will research Sjech M. Djamil Djambek contact with tarekat and his criticism of the tarekat. Tarekat Syatthariyah and Naqsabandiyah are a growing tarekat early in the Minang area. Then, the tarekats have be criticized by Ulama in Minangkabau. Sjech M. Djamil Djambek learned from tarekat. He also member of tarekat. He is accommodative figure and give constructive critique. His critic is without disregard silaturrahim (personal relationship). His critique is reason without hurt feeling. So, all parties are welcome to Sjeh M Djamil. His style is moderate and quite moderate and step forward to his time.

Abstract

Earthquake in West Sumatra, on September 30, 2009, and affects not only destroy significantly to infrastructure, but also affects the superstructure. Effects on superstructure are very visible on problem of mentality, psychology and understanding of religious. Therefore, the earthquake victim mentality may be indicated experiencing fragility and easily influenced by outside, including the influence of the belief. So, religion conversion issue is so popular in victim communities. However, there is social relationship in the community which integrity and psyche reinforcement, so victim communities are not easy to suffer split personality. Social relationship is created by religious figures, which are as religious advisor and also network creator to solve society problem. Findings are get by qualitative and in-depth interview as main data collecting method.

Abstract

Concept of social security in Islam is different than conventional concept of social security. Social security in Islam is the basic life assurance to meet the economic necessities of the community in most minimal standard for all members of society. This Notion is in line with term damān al-ijtimā’î. Responsibility for implementation is not only a state duty, but also all members of society. They are integrally responsible for achieving this goal, as the purpose is contained in the term takaful al-ijtimai.

Abstract

Economic activities did by people sometimes do not meet the principles of justice and fairness as syari’ah by the teachings of Islam. In these activities there are also the injustice and fraud elements, so some parties are aggrieved and persecuted. Therefore, in the Islamic economic system, there is an organization that works to provide legal protection for economic actors. Legal protection is applied to prevent or at least minimize injustice and tyranny. The organization is Al Hisbah institution, which have function as amar ma’ruf nahi mungkar to control economic activities in society. Organizers of Al Hisbah are named muhtasib, both appointed by state or voluntary.

Abstract

As one important branch of Islamic science, the science of usul al-fiqh occupies a crucial position. In the real fact, it’s maybe globally as a key science or the gate of the Islamic sciences. This view is not exaggerated, because the text of Islam’s doctrine of understanding is largely determined by the discipline of usul al-fiqh. Therefore it is not surprising and very logicaly if the Islamic scholars earlier (‘ulama) they put the usul al-fiqh as the science of logic (mantiq) of all the teachings of Islam. More specifically, if the key philosophy of science is the science of Greek logic, especially logic Aristotele, then the system logic of the teachings of Islam itself is the science of usul al-fiqh. However, the question that arises is the lack of interest in usul al-fiqh. This analysis can be seen in some of the side as described in this paper and presented some offers solutions to usul al-fiqh revitalization back and beneficial in many areas of life such as political issues, economics, education, environment and others. This is the meaning of fiqh in the broadest sense and universal. So, it’s look clearly related between “fiqh” (islamic law) and usul al-fiqh of Islamic scholarly discourse.
